On the Veritical Limit of 38" total. Would it be okay to use encoder to reach the height and stop or do we have to use a hard stop Mechanism and if so will one of the following count, magnetic switch, touch sensor to stop the lift mechanism.

This site is not intended as a Rules forum, but in the interest of providing you quick feedback, here are some relevant points from Rule R105 in the currently posted Competition Manual:
There are expansion limits. … ROBOTS must be physically constrained to fit within these limits without the use of software. The sizing constraints are:
…
C. Within the limitations per G415, ROBOTS may expand vertically up to 38 in. (96.50 cm).During inspection, each team will be asked to show the ROBOT’S STARTING CONFIGURATIONS and additionally its configurations at maximum mechanical extensions. Software limits are not sufficient to demonstrate maximum extensions.
ROBOTS must show their maximum mechanical extensions during the inspection process. A ROBOT that can mechanically exceed the horizontal limit would be in violation even if the ROBOT has software limiting the position of the extension during the MATCH.
The above points seems to answer your question clearly. But any FTC Coach may request a formal Q&A reply here:
